Terms and Conditions

Please take a moment to read these terms - we've tried to keep them clear and fair.

By creating an account or placing an order, you agree to two sets of terms:

These Terms include a section explaining how disputes are handled (Section 19). Your statutory rights as a consumer are not affected.

About the ninito Platform. ninito is a shared, multi-merchant platform: you sign up once, and your ninito account works across all of the independent restaurants and shops ('Merchants') on it. When you visit or order from a Merchant, ninito shares some of your account information with that Merchant so your order and features such as order history and loyalty work smoothly. ninito also uses analytics, artificial intelligence, and machine learning to learn from activity across Merchants - such as what you order and where you order from - to improve the Platform and your ordering experience. We never share your identifiable order or purchase history with one Merchant with any other Merchant; anything a Merchant receives that draws on activity across Merchants is aggregated and does not identify you. Personalised offers based on your activity across other Merchants are shown only where you have opted in, and you can object at any time. We do this in line with the ninito Platform Privacy Policy and applicable data protection law, and you can manage your choices and exercise your privacy rights as described there.

Part I: Terms of Service for the ninito Platform

1. The Agreement & Our Platform

These Part I terms govern your use of the ninito platform, provided by ninito AS, org. no. 923 377 654, Selma Ellefsens Vei 10, 0581 Oslo, Norway ('ninito', 'we').

Our Role as an Intermediary: ninito connects you ('the User') with independent Merchants. ninito provides the technology only: it is not the seller, does not prepare, sell, or deliver any products, and is not a party to your purchase.

Your Contract is with the Merchant: When you place an order, you enter into a binding contract directly with the Merchant, as detailed in Part II.

2. User Accounts & Security

Registered Accounts: You can create a global ninito account using your phone number, secured via a one-time password (OTP).

Account Security: You are responsible for maintaining the security of your mobile device. ninito is not responsible for delays or failures in receiving OTPs due to issues with your mobile network provider.

Keeping Your Account Secure: You are responsible for activity that happens under your account, so please keep your sign-in details and device secure. Please give us accurate information and let us know as soon as you can if you notice any unauthorized use of your account; you are not responsible for activity occurring after you have notified us. For unauthorized payment transactions, your rights and liability follow applicable payment services law.

Service Communications: When you create an account or place an order, you will receive necessary service messages from ninito and the Merchant about your orders (such as confirmations, status updates, and pickup alerts) by SMS, email, push notification, or another appropriate means, such as an on-screen confirmation. These are not marketing messages.

Age Requirement: You must be at least 18 years old to create an account and purchase age-restricted products.

3. Placing Orders

Binding Order: Your order is considered placed and binding once payment is completed.

No Modifications or Cancellations: Once confirmed, an order cannot be modified or cancelled through the Platform. You must contact the Merchant directly for any change requests.

Merchant's Right to Reject: The Merchant may reject your order. If rejected after payment, you will be refunded.

Order Accuracy: You are responsible for ensuring all order details are correct.

4. Prices & Payment

Prices are set by Merchants and include applicable VAT.

We use secure third-party payment processors. By providing payment information, you authorize its use. Your payment is processed by the payment processor directly for the Merchant; ninito does not receive, hold, or transmit your money at any point. Your completed payment discharges your payment obligation to the Merchant for that order. Refunds of order amounts are owed by the Merchant and are paid through the payment processor; where ninito's systems are used to initiate a refund, ninito acts only as a technical intermediary. If a payment fails, the order is not placed. If you are charged twice for the same order, the Merchant will refund the duplicate charge through the payment processor.

Orders on Behalf of a Company: If you place an order on behalf of a company or other organisation, including any order to be paid by invoice, you represent and warrant that you are authorised to place that order and to bind that company. If you are not so authorised, or if the company fails to pay, you will be personally responsible for paying for the order and covering any related unpaid amount or cost.

5. Pickup, Delivery & Fulfillment

Pickup Policy: For food-safety reasons, orders not collected within 60 minutes of the scheduled pickup time (or before the Merchant closes, whichever is sooner) may no longer be available. Because the order was already prepared for you at your request, it is generally not refunded in that case; your statutory rights remain unaffected.

Delivery Estimates: Delivery is performed by the Merchant or its delivery partners; ninito does not perform deliveries. All provided delivery times are estimates only. ninito and the Merchants make no guarantee that orders will be delivered by any specific time; your statutory remedies for delay against the Merchant remain unaffected.

No-Contact Delivery and Risk Transfer: When no-contact delivery is selected or applied to your order, the goods are delivered when they are left at the location you designated (such as your door), in accordance with your instructions; the courier will record the delivery in the Platform, including a photo where available, as documentation. At that moment, risk of loss or damage passes to you and the goods are in your care. ninito and the Merchant cannot be responsible for any loss, theft, damage, or spoilage after delivery is completed. Because of this, we recommend choosing a safe drop-off spot - and if you would rather receive your order in person, you can choose standard delivery.

Delivery Presence Requirements: For standard delivery, you must be present at the delivery location from the time of placing the order until the products have been received. Because your food is freshly prepared and brought to you, if the courier cannot reach you within five (5) minutes of arriving and you do not respond after two contact attempts, the delivery may be cancelled. As the order has already been prepared and brought out for you at your request, it is generally not refunded in that case; your statutory rights remain unaffected.

Pre-Order Delivery: For pre-ordered deliveries, you must be present at the confirmed location from ten (10) minutes prior to the scheduled delivery time until the moment of delivery.

Age-Restricted Products: If your order includes age-restricted products (such as alcoholic beverages, tobacco products, or other age-restricted items), you must provide a valid government-issued photo identification document to the courier proving that you are of the legally required age to purchase such products. You may be refused delivery of age-restricted products if: (a) you cannot provide valid identification; (b) you appear to be intoxicated; (c) the courier reasonably believes you are not of legal age; or (d) delivery is otherwise prohibited by applicable law or regulation. If delivery of age-restricted products is refused for any of these reasons, we may charge a return fee corresponding to the actual cost of bringing the products back, normally equal to the delivery fee, service fee, and any applicable surcharges for your order. The products will be returned to the Merchant, and because the sale could not lawfully be completed for reasons on your side, those products are generally not refunded; your statutory rights remain unaffected.

6. Complaints and Allergen Information

You must address any complaints about your order directly to the Merchant.

Allergen information comes from the Merchants, and ninito is not able to independently check it. If you have any allergies, please always tell the Merchant directly before ordering - you are in the best position to know your needs.

7. Promotions, Loyalty Programs, and Gift Cards

General: Except where these Terms or applicable law say otherwise, all promotional benefits - including points, rewards, membership tiers and their benefits, referral rewards, Gift Cards, and ninito Credits - have no cash value, are not your property and give you no vested right, title, or interest, cannot be redeemed for cash, and cannot be transferred, sold, assigned, or combined across accounts. Each type of benefit may also have its own rules, set by the Merchant or ninito, as described below and in Sections 8 and 9.

Eligibility and Enrollment: Promotions and loyalty programs ('Programs') are offered by each Merchant, who sets the rules for their own Program. Some Programs are offered together with marketing from that Merchant, so if you choose to stop receiving that Merchant's marketing, you may no longer be able to take part in, or keep earning under, that Merchant's Program. Any benefits you have already earned are then handled in line with the Program rules and applicable law.

Earning and Redeeming Points or Rewards: When you participate in a Program, you may earn points or rewards according to the rules set by the Merchant. Points are typically earned on qualifying purchases only. A 'qualifying purchase' means a purchase properly identified to your account. Points or rewards are only earned on the actual amount spent (excluding taxes, surcharges, fees, gratuities, bag fees, bottle deposits, and any amounts loaded onto gift cards or stored value cards). If a promotional offer or discount is applied, you will only earn points on the net amount actually paid.

Points and Rewards Expiration: Points and rewards may have a validity period, which is set by each Merchant and can vary by Program, promotion, or customer; they may expire at the end of that period. If you leave a Program, close your account, your account is closed, or a Merchant ends a Program, any unused points and rewards may expire. A Merchant may update its expiration rules from time to time; changes apply prospectively, and points already earned keep the validity period that applied when they were earned, except where a change is required by law or is needed to correct genuine errors or abuse.

Verification and Correction: Please check that points and rewards are correctly credited to your account and notify the Merchant within six (6) months of a qualifying purchase if you believe points were incorrectly calculated; older transactions may no longer be verifiable. Where a genuine crediting error is confirmed, the Merchant will correct it by crediting the missing points or rewards, which is the remedy for crediting errors.

Rewards Subject to Availability: All rewards are subject to availability and may be modified, substituted, or discontinued at any time without notice. The Merchant makes no guarantee of the continued availability of any reward. Some locations may not offer all advertised rewards.

No Refund of Points: When you redeem points or rewards for a product or service, the points are deducted from your account and are not refunded because you change your mind or are unsatisfied with a product you received as ordered. If your order is rejected or cancelled by the Merchant, or the product is unavailable, redeemed points will be re-credited to your account.

Changes to Programs: A Merchant may update, pause, or end any Program, including its rules, earn rates, redemption options, expiration rules, or the rewards offered. Changes apply prospectively and do not remove points or rewards you have already earned, except as described under 'Points and Rewards Expiration' and 'Program Integrity', where a Program ends, or where a change is required by law. A Merchant may also correct genuine errors, such as typographical or pricing errors, and will do so reasonably.

Program Integrity: To keep Programs fair for everyone, a Merchant may review, adjust, or remove points, or pause or end your participation in a Program (or, in serious cases, your account), where it has reasonable grounds to believe that points were obtained incorrectly, that a Program was misused, or that these Terms were not followed. Where that happens, affected points and rewards may be removed. The Merchant will apply this reasonably and in line with applicable law.

Membership Tiers and Status: Some Programs include membership tiers or status that come with extra benefits or perks. Each Merchant decides how its tiers work. Your tier is based on your qualifying activity, such as your spend or the points you earn, over a period set by the Merchant. If you do not reach the level of activity needed to keep your tier within that period, your tier may go down and you may lose the benefits and perks that came with it. A Merchant may update how its tiers work, including the activity needed and the benefits offered.

Gift Cards: Gift cards and stored value cards ('Gift Cards') are issued by, and are the responsibility of, the Merchant. Gift Cards have an expiry date, which is set by the Merchant and may vary by Merchant and by Gift Card; after the expiry date, any remaining balance can no longer be used, except where applicable law provides otherwise. A Merchant may choose to allow a Gift Card to be reloaded or transferred, and any redemption for cash is only where required by law. Gift Cards cannot be used to buy other Gift Cards or stored value. ninito is not the issuer of Gift Cards and is not responsible for them, including their funding, balance, expiry, acceptance, or any loss or unauthorised use.

8. Referral Programs

Referral Program Description: From time to time, Merchants may offer referral programs ('Referral Programs') through which existing users ('Referrers') can invite new users ('Referred Users') to join the Platform and place orders. Participation in any Referral Program is entirely at the Merchant's discretion and subject to the specific terms established by each Merchant.

Merchant Determines the Terms: Each Merchant decides the terms of its Referral Program, including but not limited to: (a) whether to offer a Referral Program at all; (b) who is eligible to participate (Referrer and/or Referred User); (c) what reward, if any, will be provided; (d) the amount or value of any reward; (e) whether rewards are given to the Referrer, the Referred User, or both; (f) the minimum purchase amount or number of orders the Referred User must complete before any reward is granted; (g) time limits for completing qualifying actions; (h) geographic restrictions; (i) product or category restrictions; and (j) any other terms, conditions, or restrictions the Merchant deems appropriate.

No Guarantee of Rewards: You understand and acknowledge that referral rewards are not guaranteed. The Merchant may choose not to provide any reward, may set the reward amount at any level (including zero), and may change or terminate the Referral Program at any time without notice. The Merchant has no obligation to provide any minimum reward value or to continue any Referral Program.

Qualifying Thresholds: If a Merchant offers referral rewards, the Merchant will determine the qualifying threshold that the Referred User must meet before the Referrer (or Referred User, as applicable) receives any reward. This threshold may be based on a minimum purchase amount, number of orders, specific products purchased, or any other criteria set by the Merchant. The Referrer has no right to a reward unless and until the Referred User fully satisfies all qualifying conditions as determined by the Merchant.

Referral Tracking: When you refer a new user, you may be able to track the progress of your referral through the Platform, including whether the Referred User has registered, placed orders, and met any qualifying thresholds for rewards. This tracking information is provided for your convenience only and does not create any obligation for the Merchant to provide a reward. The Merchant determines whether the qualifying conditions have been met.

Rewards as Credits or Discounts: Referral rewards, if any, are typically provided as ninito credits, discount codes, or other promotional benefits as determined by the Merchant. Referral rewards may have expiration dates and usage restrictions as set by the Merchant.

Fair Use of Referral Programs: Please use Referral Programs fairly. Creating fake accounts, using automated systems, self-referring, repeatedly referring the same person, or other fraudulent or deceptive practices are not allowed. ninito and the Merchant may investigate suspected abuse and may reverse rewards obtained through abuse or fraud, end your participation in Referral Programs, and, in serious cases, suspend or close your account.

Changes to Referral Programs: A Merchant may change, pause, or end any Referral Program, and ninito may change, pause, or end the referral feature of the Platform. If a Referral Program ends, any pending or unclaimed rewards may no longer be available.

9. ninito Credits, Promotional Codes, and Tokens

Obtaining Credits and Promotional Codes: Users may obtain ninito credits, promotional codes, discount tokens, or other promotional benefits ('Credits') through various means, including but not limited to: (a) referral programs; (b) loyalty programs; (c) promotional campaigns established by ninito or Merchants; (d) compensation for service issues; (e) promotional partnerships; or (f) other promotional activities. The availability and terms of Credits are decided by ninito and/or the applicable Merchant.

Promotional Campaign Terms: Credits obtained through promotional campaigns are subject to the specific terms and conditions established for each campaign. Promotional offers: (a) may only be used by the intended audience and for the intended purpose; (b) may not be duplicated, sold, transferred, or made available to the general public unless expressly permitted; (c) may be limited to specific Merchants, products, times of day, or geographic areas; (d) may require minimum purchase amounts; (e) cannot be combined with other offers unless expressly stated; and (f) are subject to availability and while supplies last.

How Credits Are Used: Credits can only be used on the Platform to obtain discounts on qualifying purchases, as specified in the applicable terms.

Expiration: Credits have a validity period, shown when they are granted or in your account, and can no longer be used after they expire. Credits may also be withdrawn if your account is suspended or closed, if these Terms are breached, if abuse or fraud is detected, or if the Credits were granted in error.

Single Use: Credits, including signup bonuses and one-time promotional Credits, can only be used once per account. You may only have one account and may only claim each promotional offer once, unless expressly stated otherwise.

Changes to Credit Terms: ninito and Merchants may set or update the terms that apply to Credits, including eligibility requirements, redemption procedures, expiration periods, and applicable restrictions, and may change or end promotional campaigns.

Fair Use of Credits: If we or a Merchant find that Credits were misused, obtained through fraud, or granted by mistake, we may remove those Credits, ask you to pay back any amount that was covered by them, and in serious cases pause or close your account. We will apply this reasonably and in line with applicable law.

10. Your Responsibilities & Platform Use

You agree to use the Platform lawfully. Prohibited activities include, without limitation: fraudulent orders; filing illegitimate chargebacks; abusive, threatening, or harassing behavior towards Merchants, their staff, couriers, or other users; creating multiple or fake accounts; misusing promotions, Credits, or referral features; scraping, crawling, or automated access to the Platform; interfering with or circumventing the Platform's security or technical restrictions; and reselling or commercially exploiting the Platform without ninito's written consent.

11. User-Generated Content

If the Platform allows you to post content, such as reviews or ratings ('User Content'), you're responsible for the content you post.

You grant ninito a worldwide, royalty-free, non-exclusive, sublicensable, and transferable licence to use, reproduce, adapt, and display your User Content in connection with operating, improving, and promoting the Platform. This licence ends when you delete the content or your account, except for copies we must keep by law, content others have already shared, and uses of the content in aggregated or de-identified form.

ninito has the right, but not the obligation, to monitor and remove any User Content that we deem to violate these Terms.

The Platform may contain links to third-party websites. ninito has no control over, and assumes no responsibility for, the content or practices of any third-party websites.

13. ninito's Role and Limitation of Liability

We work hard to keep the Platform running well, but we provide the technology Platform on an 'as available' basis and cannot promise it will always be uninterrupted or error-free. ninito is not responsible for the products, their preparation, safety, allergen information, pricing, menu content, order fulfilment, or delivery, nor for the acts or omissions of Merchants, their staff, their delivery partners, or payment processors; such matters are between you and the Merchant under Part II. ninito is not liable for events outside its reasonable control (force majeure). To the extent permitted by law, and without affecting your statutory rights as a consumer or ninito's liability for gross negligence or intent: ninito is not liable for indirect losses. Claims relating to your order, including refunds of the order amount, are the Merchant's responsibility and must be directed to the Merchant under Part II; ninito is not liable for the order amount. ninito's total liability for any claim relating to the technology Platform itself is limited to any fees you paid to ninito for the use of the Platform in connection with the order concerned. Remember that your purchase contract is with the Merchant, which is responsible for the products themselves and for your payment-related claims (see Part II).

14. Intellectual Property

All content and software on the ninito Platform are the exclusive property of ninito AS.

15. Privacy

Your use of the Platform is governed by the ninito Platform Privacy Policy.

16. Account Suspension and Termination

ninito may suspend or close your account where you seriously or repeatedly breach these Terms, or in cases of fraud or abuse, and will let you know where practical. If your account is closed, your participation in Programs ends, and any points and rewards are handled as described in Section 7.

17. Indemnification

To the extent permitted by law, and without affecting your mandatory rights as a consumer, you agree to cover the reasonable costs ninito or a Merchant incurs because you broke these Terms or the law, or infringed someone else's rights.

18. General Provisions

Changes to Terms: We may update these Terms from time to time. When we do, we will post the updated Terms and update the date above. For changes that materially affect your rights or obligations, we will notify you (for example by email or in-app message) at least 30 days before they take effect, where practicable. Your continued use of the Platform after an update takes effect means you accept the updated Terms; if you do not accept them, you can stop using the Platform and close your account at any time.

Governing Law: These Terms are governed by the laws of Norway without regard to conflict of law principles. If you are a consumer residing in Sweden or Denmark, you additionally enjoy the mandatory consumer protections of your country of residence, and nothing in these Terms deprives you of them.

Severability: If any provision is found to be unenforceable, the remaining provisions will remain in full force.

No Waiver: Any failure by ninito to enforce any right or provision of these Terms will not be considered a waiver of those rights.

Entire Agreement: These Terms and the Privacy Policy constitute the entire agreement between you and ninito.

Assignment: You may not assign or transfer these Terms or your account without ninito's prior written consent. ninito may transfer these Terms to another company (for example, as part of a reorganisation or sale of the business), and your rights under these Terms will continue to apply.

19. Dispute Resolution and Governing Law

We want every issue resolved fairly. If something goes wrong, please contact ninito customer support first - we will do our best to help, including by liaising with the relevant Merchant.

Your Consumer Rights Come First: If you are a consumer in Norway, Sweden, Denmark, or elsewhere in the EEA, nothing in this section limits the mandatory rights you have under the consumer protection law of your country of residence. You can always bring a dispute before the ordinary courts of your country of residence. You can also refer a complaint to the consumer bodies of your country: in Norway, the Norwegian Consumer Authority (Forbrukertilsynet), the Norwegian Consumer Council (Forbrukerrådet), or the Consumer Disputes Committee (Forbrukerklageutvalget); in Sweden, the Swedish Consumer Agency (Konsumentverket) or the National Board for Consumer Disputes (Allmänna reklamationsnämnden, ARN); in Denmark, the Danish Consumer Ombudsman (Forbrugerombudsmanden) or the Centre for Complaint Resolution and the Consumer Complaints Board (Nævnenes Hus / Forbrugerklagenævnet). These rights always apply, regardless of anything else in these Terms.

Business Users - Arbitration: If you use the Platform as a business rather than as a consumer, any dispute relating to these Terms or the Platform that cannot be resolved amicably will be settled by binding arbitration seated in Oslo, Norway, conducted under the Norwegian Arbitration Act of 2004, rather than in court. If you are a Merchant bound by ninito's merchant Terms of Service, the dispute resolution provisions of that agreement apply instead of this section. For business users, claims may be brought only on an individual basis and not as part of a class or representative action. Judgment on the award may be entered by any court with jurisdiction. If you are a business user, you may opt out of this arbitration agreement by writing to ninito at policy@ninito.no within thirty (30) days of first accepting these Terms, stating your name, address, and that you wish to opt out.

Exceptions: Either party may still bring a qualifying claim in the small claims court, and either party may ask a court for urgent relief to protect intellectual property rights.

Merchant Disputes: Issues about your purchase itself (such as product quality, delivery, or a Merchant's own policies) are between you and the Merchant; ninito will help facilitate a resolution. The approach in this section applies to those disputes in the same way.

Part II: Terms and Conditions of Purchase from BALKAN PIZZA & KEBABHOUSE AS

This part of the agreement is directly between you and the Merchant.

2. Pricing, Promotions, and Order Errors

The Seller may cancel or correct an order if there is an error in pricing, product description, or availability, or if a discount or promotion was applied incorrectly. In the event of an error, the Seller will try to contact you so that you can choose between proceeding on the corrected terms or receiving a full refund. Offers, promotions, and prices may change over time and may vary by location.

3. Product Substitutions

Out-of-Stock Products: Products offered through the Platform may be temporarily out of stock. If you have enabled substitutions for your order (prior to completing your purchase), you authorize the Merchant to substitute out-of-stock items with similar items at the Merchant's discretion.

Substitution Principles: When the Merchant substitutes an out-of-stock item, the Merchant will select a substitute based on what the Merchant considers to be the most appropriate alternative, considering factors such as quantity, quality, and price similarity to the original item. The Merchant will make reasonable efforts to substitute: (a) allergen-safe equivalents (e.g., lactose-free items substituted only with lactose-free items, gluten-free with gluten-free); (b) diet or light products with diet or light alternatives; (c) organic products with organic alternatives where available; and (d) similar flavor profiles where reasonably possible. However, the Merchant makes no guarantee that substitutes will match all characteristics of the original item.

Pricing of Substitutes: If the substitute item is more expensive than the original item, you will not be charged more than the price of the original item. If the substitute item is less expensive, you will be charged the lower price of the substitute.

About Substitutions: The Merchant chooses substitutes carefully but cannot promise a substitute will be a perfect match, so it is not responsible if a substitute is not quite what you expected. If you would rather not receive substitutes, you can turn them off before you order. If you have not enabled substitutions and an item is out of stock, the Merchant will fulfill the remaining portion of your order without the unavailable item, and you will not be charged for the unavailable item.

4. Weight-Based Pricing

Variable-Weight Products: Certain products are sold by weight (such as fresh produce, meat, deli items, or bulk goods). For weight-based products, the exact weight and therefore the exact price cannot be determined until the product is weighed by the Merchant.

Estimated Pricing: When you add a weight-based product to your order, the price displayed is only an estimate based on an assumed average weight. The final price will be determined by the actual weight of the product you receive.

Authorization Hold: To cover potential price variations for weight-based products, ninito or the payment processor will make a temporary authorization hold on your payment method. The amount of this authorization hold will be up to twenty percent (20%) above the estimated value of weight-based products in your order.

Final Pricing and Adjustments: After your order is fulfilled, the final price will be charged based on the actual weight of each weight-based product. If the actual weight is less than estimated, you will be refunded the difference. If the actual weight is greater than estimated, you will be charged the additional amount from the authorization hold. Any unused portion of the authorization hold will be released or refunded according to your payment method's standard procedures.

Acceptance of Weight Variance: By ordering weight-based products, you acknowledge and accept that the final price may differ from the estimated price, and you authorize ninito and the Merchant to charge you the actual price based on actual weight.

5. Minimum Order Values and Fees

Merchant-Set Minimums: Merchants may establish minimum order values for orders placed through the Platform. If a minimum order value applies, you will be notified before you complete your purchase.

Meeting Minimum Requirements: If your order does not meet the Merchant's minimum order value, you will have the option to: (a) add additional items to your order to meet the minimum; or (b) pay a small order fee equal to the difference between your order value and the minimum order value.

Merchant Discretion: Minimum order values, small order fees, and the availability of either option are determined solely by the Merchant and may vary by Merchant, location, time of day, or delivery method.

6. Allergens and Dietary Information

The Seller provides allergen information as required by law but cannot guarantee an entirely allergen-free environment. If you have a severe allergy or dietary restriction, always contact the Seller directly before ordering so the Seller can advise whether the order is suitable for you.

7. Collection and Service Refusal

Orders that are not collected as described in Part I have already been prepared for you, so they cannot be refunded (see Part I, Section 5).

To keep its staff, customers, and premises safe, the Seller may decline service where reasonably necessary - for example, in cases of suspected intoxication, abusive behaviour, or a breach of these Terms.

8. Right of Withdrawal

Because food, drinks, and other perishable goods can spoil quickly, the statutory 14-day right to change your mind does not apply to them, and such items cannot be returned for a change of mind. This does not affect your right to a refund where an order is rejected (Part I, Section 3) or where a product is defective (see 'Complaints, Defects, and Product Liability' below), or your statutory withdrawal right for non-perishable goods (Section 11).

9. Seller's Limited Liability

The Seller is not liable for failures to deliver or perform due to circumstances beyond its reasonable control (force majeure), including but not limited to acts of God, natural disasters, strikes, or government actions.

To the fullest extent permitted by law, the Seller is not liable for indirect or consequential losses, and the Seller's total liability to you for any claim arising out of your purchase shall not exceed the amount you paid for the specific order giving rise to the claim. These limitations apply for the benefit of the Seller and its owners, employees, and delivery partners. They do not apply to personal injury, to liability under applicable product liability legislation, to gross negligence or intent, or where mandatory consumer law provides otherwise.

10. Privacy

Your personal data is processed in accordance with the ninito Platform Privacy Policy.

11. Right of Withdrawal for Consumers

Norwegian Consumer Rights: Orders on the Platform are typically freshly prepared food and beverages, to which the statutory right of withdrawal does not apply (see Section 8). This section applies only in the exceptional case where you purchase goods covered by the right of withdrawal. If you are a consumer (a natural person using the Platform for purposes outside your trade, business, craft, or profession), you then have a statutory right of withdrawal in accordance with the consumer protection law of your country of residence (in Norway angrerettloven, in Sweden distansavtalslagen, in Denmark forbrugeraftaleloven).

Limitations on Right of Withdrawal: The right of withdrawal does not apply to Purchase Agreements concerning: (a) goods liable to deteriorate or expire rapidly, such as fresh food and beverages; (b) sealed goods which are not suitable for return due to health protection or hygiene reasons, if unsealed after delivery; (c) goods made to your specifications or clearly personalized; (d) sealed audio, video, or software which was unsealed after delivery; or (e) goods which, by their nature, are inseparably mixed with other items after delivery.

14-Day Withdrawal Period: For goods to which the right of withdrawal applies, you may withdraw from the Purchase Agreement within 14 days from the day of delivery without giving a reason. To exercise your right of withdrawal, you must inform the Merchant (through ninito customer service or directly) by means of a clear statement (email or in-app message) within the 14-day period. You must return the goods to the Merchant as soon as possible and no later than 14 days after notifying us of your withdrawal. You bear the direct costs of returning the goods. You may examine the goods as you would in a shop; if the value of the goods is reduced because you have used or handled them beyond what is necessary to establish their nature, characteristics, and function, the Merchant may deduct an amount corresponding to the reduction in value from your refund.

Refunds: If you withdraw from a Purchase Agreement, the Merchant will refund all payments received from you, including delivery fees, through the payment processor, no later than 14 days from the date notice of your withdrawal was received. The refund will be made using the same payment method you used for the original purchase, unless expressly agreed otherwise. The Merchant may withhold the refund until the goods have been returned or you have provided proof of return, whichever is earlier.

12. Complaints, Defects, and Product Liability

Inspection Obligation: You are responsible for inspecting the products in your order without undue delay after receiving the order. For perishable goods such as food, inspection should occur immediately upon receipt.

Reporting Defects: If there are any defects, quality shortcomings, missing items, or non-conformities in the products, please notify the Merchant (through ninito customer service or directly) as soon as possible; for perishable goods, prompt notice makes it much easier to verify and resolve the issue. Notice is always timely if given within two (2) months of when you discovered the defect, and your statutory complaint periods under the applicable consumer purchases legislation of your country of residence apply. The Merchant or ninito may request photographic documentation of the defect.

Merchant Liability: The Merchant is solely responsible for the quality, safety, accurate labeling, and packaging of their products. The Merchant has statutory defect liability for their products as set out in the applicable consumer purchases legislation of your country of residence (in Norway forbrukerkjøpsloven, in Sweden konsumentköplagen, in Denmark købeloven). You may be entitled to remedies including price reduction, replacement, repair, or cancellation of the Purchase Agreement and refund, in accordance with applicable law.

ninito's Role: ninito acts as an intermediary and technology provider and is not part of the payment flow, which runs directly between you, the payment processor, and the Merchant. While ninito facilitates complaints and its systems may be used to initiate refunds on the Merchant's instruction, the Merchant retains ultimate responsibility for product quality, defect liability, and all refunds. ninito does not guarantee the accuracy of information provided by Merchants regarding menus, ingredients, allergens, prices, or opening hours.

13. Conflict Resolution and Governing Law

Governing Law: All purchases are governed by Norwegian law without regard to conflict of law principles. If you are a consumer, you cannot be deprived of the protection afforded by mandatory provisions of Norwegian consumer protection law or the law of your country of domicile.

Complaints Process: Complaints regarding your order should be directed to the Merchant through ninito customer service or directly to the Merchant. ninito will assist in facilitating the resolution of complaints.

Dispute Resolution for Consumers: If you are a consumer in Norway, Sweden, or Denmark, you have the right to: (a) bring disputes before the courts of your country of residence, regardless of these Terms; (b) refer disputes to the consumer bodies of your country: in Norway the Norwegian Consumer Authority (Forbrukertilsynet) and the Consumer Disputes Committee (Forbrukerklageutvalget), in Sweden the Swedish Consumer Agency (Konsumentverket) and the National Board for Consumer Disputes (Allmänna reklamationsnämnden, ARN), and in Denmark the Danish Consumer Ombudsman (Forbrugerombudsmanden) and the Consumer Complaints Board (Forbrugerklagenævnet via Nævnenes Hus); or (c) use other out-of-court dispute resolution mechanisms provided under national or EU law. These consumer rights apply regardless of anything else in these Terms. The arbitration provisions in Part I, Section 19 apply only to business users and do not apply to you as a consumer.

Business Disputes: For disputes not involving consumers (such as disputes between businesses), the arbitration and class action waiver provisions set forth in Part I, Section 19 apply, to the fullest extent permitted by law.

Acceptance of Combined Terms

By completing your order, you confirm that you have read, understood, and agree to be bound by both Part I (Terms of Service for the ninito Platform) and Part II (Terms and Conditions of Purchase from BALKAN PIZZA & KEBABHOUSE AS). If you are a consumer, your mandatory rights under the consumer protection law of your country of residence are preserved notwithstanding any other provisions in these Terms.
